Andrzej Duda in RMF FM: The rule of law in Poland is being violated only now

– I do not see the need to change the Act on the National Council of the Judiciary at the moment, since the European Commission has officially closed the case of violating the rule of law in Poland – said Andrzej Duda on RMF–FM, when asked whether he would sign the compromise amendment to the Act on the National Council of the Judiciary. – As it turns out, it was enough to change the government in Poland for the EC to restore the rule of law – he added.

During a morning conversation on RMF-FM, the President of the Republic of Poland commented the work on changes to the Act on the National Council of the Judiciary. – The basic element that I always consider due to the duties of the office of the President of the Republic of Poland is compliance with the constitution, while this act raise absolutely gigantic doubts in this respect, namely the interruption of the term of office of the current National Council of the Judiciary. This is a situation that raises huge constitutional doubts, said Andrzej Duda.


– But what kind of compromise is it anyway? – pointed out the President of the Republic of Poland. – After all, the European Commission recently completed the procedure under Art. 7, they said that everything was fine in Poland. They said that the rule of law in Poland had already been restored, there was no need to change the law in any way. It turned out that we are already a law-abiding country, said Andrzej Duda.


He pointed out that no conditions were imposed on Poland. – I do not see the need to change the act on the National Council of the Judiciary at the moment, since the European Commission has shouted so much about it, among others. this is a violation of the rule of law, and at the moment it turns out that it is no longer the case. These are the facts.


I'm smiling because - as it turns out - a change of power in Poland was enough for the EC to restore the rule of law. This is a very specific approach when it comes to democracy, he said.


When asked about the dispute over the Polish Ambassador to NATO, Tomasz Szatkowski, whom the government wants to dismiss, the President repeated that he did not see any justification for recalling the ambassador at the moment, a month before the NATO Summit in Washington. – Nobody does such things, nobody dismisses ambassadors a month before the most important meeting of allies of the year – he said. He assessed that the documents he received from the government regarding this matter "are absolutely not - in my opinion - documents compromising Ambassador Szatkowski."


Commenting on the conflict over changes regarding Poland's other diplomatic missions, Andrzej Duda said: - Minister Sikorski is not a lawyer, so I do not expect him to have deep knowledge of constitutional law, but basic reading of the constitution should, at least to a small extent, also be the domain of constitutional law. ministers. It is clearly written there that the principle of cooperation applies to all of us, i.e. the President on the one hand, but also the Prime Minister and the Minister of Foreign Affairs.


– Unfortunately, we are currently dealing with a situation in which the government is violating the procedures for nominating diplomats for ambassadorial functions, procedures that have been operating in Poland for over thirty years – emphasized the President. – Currently, there are attempts to nominate people for ambassadorial positions by force, without the preliminary consent of the President of the Republic of Poland, which means that such a candidate for ambassador is proposed to a foreign country, the country initially agrees to accept him, and then there is a problem because the President has different opinion. In this way, Poland will be discredited in the international arena. The current procedure allowed us to avoid this.


Today, those in power are trying to use force.


Andrzej Duda said that today there are thirty vacant positions in Polish institutions and the government has not nominated any candidates for any of these institutions.


When asked whether the President of the Republic of Poland becomes a defender of PiS's state of affairs, among others, at diplomatic missions, in the public media, in the prosecutor's office and in courts, he replied: - First of all, I am a defender of the constitutional order and legal order. Many of these actions, for example the removal of the National Prosecutor and the attempt to appoint a new one in his place, were absolutely illegal.


The rule of law in Poland is actually being violated only now. It wasn't there before, everything was agreed on democratic principles and everything was based on laws, not on the orders of the Prime Minister and the whim of ministers, he said.


When asked about the accusations surrounding the Red is Bad clothing company, Andrzej Duda replied that any clothing company could have produced attractive, commemorative T-shirts related to the anniversaries of the Warsaw Uprising. – And I actually wore these T-shirts. "My only contact with this company is wearing their clothing," he replied.
