President of the Constitutional Tribunal, Julia Przyłębska: Disrespecting the law exposes us to the dismantling of the state

The President of the Constitutional Tribunal, Julia Przyłębska, was a guest at the 19th Meeting of Gazeta Polska Clubs in Sulejów, where she talked about the role of the Constitutional Tribunal and the challenges it faces.


"The Constitutional Tribunal exists and has existed. My term ends in December this year. I can say that from the moment I started working as a judge of the Constitutional Tribunal, I faced constant harassment."

Przyłębska pointed out in a conversation with redactor Tomasz Sakiewicz.


Society support


Przyłębska emphasized the importance of citizens' support for the Tribunal's activities. - "One gets used to it, so every such gesture, when the Tribunal received support, when it saw support among ordinary citizens, was very encouraging. Your opinion is extremely important. All problems begin to change the meaning," she added.


The Constitutional Tribunal as a collegial institution


President Przyłębska emphasized that the Tribunal is a collegial institution, not a single-person institution, as it is often presented. - "The Tribunal consists of 15 judges of the Constitutional Tribunal. The judgments issued by the Tribunal are passed by a majority vote. There are also many dissenting opinions, which shows that it is untrue that the Tribunal is a single-person body," she denied.


Illegal actions of the new government


Przyłębska criticized the actions of the new government, which, in her opinion, was acting illegally. - "The new authorities have invented a completely unlawful way of functioning through acts that are not anchored in the constitution. Resolutions of the Sejm cannot create a legal norm that is to be the basis for the functioning or non-recognition of the judgments of the Constitutional Tribunal," she explained.


Dismantling the state by disregarding the law


Since the new coalition took power, the rulings of the Constitutional Tribunal have not been respected. Przyłębska drew attention to the dangers associated with such an approach. - "In the long run, such functioning exposes us to the risk of dismantling the state. If at a given moment the society or the nation says - our views on the functioning of the state have changed, then it chooses such a majority that is able to change this constitution. Now there is actually powerlessness, because the functioning in a rogue way, without a legal basis, through created legal concepts, it will cause the destruction of the state," she explained.


Summing up her speech, Julia Przyłębska emphasized that the fight for sovereignty and the rule of law is crucial. - "The situation is complicated and we must fight for this sovereignty - by fighting against illegal actions," she emphasized.


The President of the Constitutional Tribunal pointed out that the actions of the elites in the past led to the collapse of Poland, and the current generations should learn from these mistakes so as not to repeat them.
